British Expats in Colombia Guide 2026: UK Statutory Residence Test, No UK–Colombia Tax Treaty, NHS Ends at Departure, and British Embassy Services in Bogotá

The UK has no double taxation treaty with Colombia. British nationals face a genuine dual-residency tax trap: the Statutory Residence Test (SRT) can keep you UK-resident even while Colombia's 183-day rule makes you a Colombian tax resident. NHS coverage ends when you leave the UK — Art. 11 is mandatory from day 1. This guide covers the SRT, the no-treaty double exposure, and British Embassy services in Bogotá.

James moved from Edinburgh to Bogotá in early 2024, assigned by his law firm to manage a three-year Colombian project. He had a practical advantage most expats lack: a legal background. He read the Colombian immigration resolution before his move. He obtained his Art. 11 plan through CoVisas two weeks before his visa was approved. He set up his Colombian bank account within his first week. Where James encountered genuine complexity was the intersection of UK tax law and Colombian tax residency — a collision he described to his firm's tax department as "two countries that both think they have the right to tax me, and neither has a treaty with the other to sort it out." The UK–Colombia relationship has no comprehensive double taxation treaty. The UK's Statutory Residence Test (SRT) — introduced in 2013 — determines UK tax residency through a complex points-based assessment that does not simply stop at 183 days abroad. Meanwhile, Colombia's 183-day rule applies in parallel. British nationals in Colombia can find themselves in a genuine dual-residency tax bind: liable in the UK as a UK tax resident who has not fully exited, and liable in Colombia as a Colombian tax resident. This guide covers the four UK-specific complications: the Statutory Residence Test and UK tax exit, the absent UK–Colombia tax treaty, NHS coverage (ended at emigration), and British Embassy services in Bogotá.

The Statutory Residence Test: UK Tax Exit Is Not Simple

Unlike most countries where tax residency ends after a specific number of days abroad, the UK uses the Statutory Residence Test (SRT) — a multi-factor assessment introduced by the Finance Act 2013 that considers: the number of days spent in the UK in the current and previous tax years, ties to the UK (family, accommodation, work, substantive work ties), and whether you are arriving in or departing from the UK. Broadly: if you spend fewer than 16 days in the UK in a tax year, you are automatically non-resident for that year regardless of ties. If you spend 16–45 days with 4+ UK ties, you may remain UK resident. If you spend 46–90 days with 3+ ties, you may remain resident. The key complexity for expats in Colombia: someone who moves to Colombia mid-year, retains a UK property (a tie), has UK spouse or children (a family tie), and visits the UK for holidays or work may continue to meet the SRT threshold for UK tax residency — even while also triggering Colombian tax residency. Without a UK–Colombia treaty, both countries tax the same income. HMRC publishes the SRT guidance at gov.uk/guidance/statutory-residence-test-srt — read it, then engage a UK chartered tax advisor (CTA) who specialises in emigration before you leave.

No UK–Colombia Tax Treaty: The Double Exposure

The United Kingdom does not have a comprehensive double taxation agreement with Colombia. Unlike the US–UK treaty (which protects US citizens from full UK taxation and vice versa), or the Germany–Colombia DBA, there is no bilateral instrument to allocate taxing rights between the UK and Colombia. The practical consequence: if you are simultaneously a UK tax resident (under the SRT) and a Colombian tax resident (183+ days), both tax authorities have a legal claim on your worldwide income. Both the UK State Pension and private UK pensions (workplace pensions, SIPPs) paid to a Colombian-resident UK national will be subject to UK PAYE withholding — and Colombia, as country of residence, can also tax those same payments. The Foreign Tax Credit (FTC) under UK and Colombian domestic law may provide some partial relief — you can claim a credit in one country for tax paid in the other — but domestic FTC mechanisms are less reliable than treaty-based relief and require case-by-case calculation. The bottom line: dual UK/Colombia tax exposure is a real risk. It is not hypothetical. Engage a UK emigration tax specialist before leaving.

NHS: Your Coverage Ends When You Leave the UK

The National Health Service (NHS) provides healthcare to UK residents — not UK citizens. When you establish residence abroad, you are no longer entitled to NHS care as a routine matter. You retain the right to NHS care when physically present in the UK (for urgent treatment), but your routine healthcare in Colombia is not covered. The transition: when you leave the UK for Colombia on a Visa M, your NHS entitlement effectively ends on your date of departure for permanent residence purposes. You need a Colombian Art. 11 plan immediately. There is no grace period. Some UK private health insurers (Bupa International, AXA Global) offer international expat health insurance policies that can complement but not substitute for the mandatory Colombian Art. 11. The Art. 11 is the visa-qualifying instrument — without it, your Visa M application is rejected regardless of any other coverage you hold.

British Consular Services in Colombia

The United Kingdom maintains an Embassy and Consulate in Bogotá and an Honorary Consulate in Medellín. British Embassy Bogotá — Cll 98 #9-03, Bogotá. Telephone: +57 601 326-8300. Website: gov.uk/world/colombia. The Embassy provides: emergency travel documents (ETD) if your passport is lost or stolen, consular assistance in emergencies (arrest, death of a family member, serious illness), notarial services (limited), and voter registration for UK elections abroad (overseas voter registration). UK passport renewals for British nationals in Colombia are processed online through the HMRC passport service — the Embassy does not issue new passports. Post-Brexit note: British nationals lost automatic right of residence in EU countries in January 2021 — this does not affect Colombia directly, but British nationals with EU citizenship (Irish, etc.) should be aware of which nationality's documents to use for Colombian immigration purposes.

✅ Checklist for British Nationals Moving to Colombia

Before leaving the UK: Obtain Art. 11 plan before visa application (CoVisas — NHS ends at departure). Engage a UK emigration CTA (chartered tax advisor) to assess your SRT position and UK tax exit date. Check your UK ties — property, family, work — that may keep you UK-resident under the SRT. Register as an overseas voter at gov.uk/register-to-vote.
Upon arrival in Colombia: Get cédula de extranjería within 30 days of visa approval. Register at the British Embassy (Cll 98 #9-03 Bogotá, gov.uk/world/colombia). Open Colombian bank account (Bancolombia or Davivienda).
After day 183: Colombian tax residency begins. Engage Colombian contador. File declaración de renta for worldwide income. Check SRT status for UK — if UK-resident under SRT and Colombian-resident simultaneously, seek specialist advice immediately. No UK–Colombia treaty: domestic FTC may provide partial relief but is not guaranteed.
