Tax Residency in Colombia: No Double-Taxation Treaty with Equatorial Guinea

There is no Convention for the Avoidance of Double Taxation (CDI) between Colombia and Equatorial Guinea. Equatoguinean nationals who become Colombian tax residents — by spending more than 183 days in Colombia within any 365-day period — are subject to Colombian income tax on their worldwide income at progressive rates up to 39%, with no formal mechanism to offset taxes already paid in Equatorial Guinea.

Equatorial Guinea's tax authority, the Dirección General de Impuestos, operates a progressive personal income tax system with brackets from 0% to 35%. The country levies a VAT of 15% and generates most government revenue from the oil sector (ExxonMobil, Hess). There is no capital gains tax and no inheritance tax in Equatorial Guinea. Equatoguinean nationals living abroad should seek independent cross-border tax advice to manage potential dual obligations efficiently, especially if they retain income-generating assets or business interests in Equatorial Guinea.

Document Legalization for Colombia (Non-Hague Country)

Equatorial Guinea is not a member of the Hague Apostille Convention. Documents issued in Equatorial Guinea must therefore go through a four-step legalization process to be recognized in Colombia.

Important note for Equatoguinean nationals: Since Spanish is an official language of Equatorial Guinea, documents originally issued in Spanish do not require translation into Spanish for use in Colombia. However, any documents issued in French or Portuguese must still be translated.

  1. Notarize the document before a recognized notary or competent issuing authority in Equatorial Guinea (e.g., Registrar, court clerk, or licensed notary in Malabo or Bata).
  2. Authentication by the Ministerio de Asuntos Exteriores of Equatorial Guinea in Malabo — the Ministry must certify the notary's or issuing authority's signature.
  3. Authentication by the Colombian Embassy in Yaoundé — the Embassy (accredited for Equatorial Guinea) must then legalize the Ministry seal and signature for Colombian use.
  4. Certified translation (if applicable) — documents issued in French or Portuguese must be translated into Spanish by a translator certified by the Colombian Superior Council of the Judicature. Spanish-language documents skip this step.

Criminal Record Certificate (Certificado de Antecedentes Penales)

Colombia requires a police clearance covering the last three years. Equatoguinean nationals obtain their Certificado de Antecedentes Penales from the Policía Nacional de Guinea Ecuatorial or from the Fiscalía General in Malabo. Equatoguineans residing abroad may request this through the Ecuatoguinean Embassy in Madrid or Washington D.C. The certificate must then follow the four-step legalization process above.
