Tax Considerations — CAN Decision 578
Ecuador and Colombia are both members of the Andean Community (CAN — Comunidad Andina). CAN Decision 578 (2004) is a multilateral tax convention among member states (Colombia, Ecuador, Peru, Bolivia) that prevents double taxation and regulates the allocation of taxing rights. Unlike bilateral DTTs, Decision 578 applies the source principle: income is generally taxed only in the country where it is generated. An Ecuadorian resident in Colombia who receives business income, dividends, or rental income from Ecuador pays tax on that income only in Ecuador — Colombia cannot also tax it. The SRI (Servicio de Rentas Internas) is Ecuador's tax administration.
⚠️ CAN Decision 578 — Practical Notes
Decision 578 covers most income types but each category has specific rules. Professional services income (Art. 14) is taxed where the activity is performed — meaning work physically done in Colombia is taxable in Colombia. Employment income (Art. 15) is taxed where the employer is based. Pensions (Art. 18) are taxable only in the state of residence. Document Legalization
Ecuador acceded to the Hague Apostille Convention in 2005. The competent apostille authority is the Ministerio de Relaciones Exteriores del Ecuador (in Quito) and regional consular offices. Criminal background certificates (Certificado de Antecedentes Penales) are issued by the Ministerio del Interior / DINASED. Since Ecuador and Colombia are both Spanish-speaking, no translation is required for documents submitted in Spanish to Colombian immigration.
