7. Tax Obligations — Thailand & Colombia
⚠️ Critical 2024 Change: Thai Foreign-Source Income Now Taxable
A landmark change in Thai tax law took effect on January 1, 2024. Under Revenue Instruction Paw.161/2566, all foreign-source income remitted to Thailand — regardless of when it was earned — is now taxable for Thai tax residents (those spending 180 or more days in Thailand in a calendar year). This overturned the previous interpretation under which only income earned in the same calendar year as remittance was taxable. The practical effect: Thai tax residents can no longer defer taxation by holding foreign income offshore and remitting it in a later year. Progressive personal income tax rates in Thailand range up to 35% on income above THB 5 million annually. This change is particularly relevant for Thai nationals with investment income, rental income, cryptocurrency gains, or overseas employment income who maintain Thai tax residency while also living abroad part of the year.
For Thai nationals who become Colombian tax residents by spending more than 183 days in Colombia in a calendar year, Colombian tax obligations also arise on worldwide income. Colombia and Thailand do not have a Double Taxation Agreement (DTA/CDI — Convenio para Evitar la Doble Imposición). This means income could theoretically be subject to taxation in both countries, depending on your residency situation. 8. Document Legalization — Thailand Is NOT a Hague Apostille Member

Unlike many countries, Thailand is not a member of the Hague Convention of 5 October 1961 Abolishing the Requirement of Legalisation for Foreign Public Documents (Apostille Convention). This means the simplified apostille procedure is not available for Thai documents. Instead, Thai nationals must follow the full diplomatic legalization chain — a multi-step process involving multiple government agencies. Plan for several weeks of processing time and associated costs.
The full diplomatic legalization process for Thai documents to be used in Colombia is as follows:
- Obtain the original Thai document — Criminal Record Certificate (ใบรับรองความประพฤติ) from the Royal Thai Police Immigration Bureau Special Branch, or birth/marriage certificates from local district offices (Amphoe). Ensure documents are current (typically issued within 90 days).
- Thai notary / official notarization — Have the document notarized by a Thai notary public or certified by the relevant issuing authority to confirm its authenticity and the official's signature.
- Authentication by the Ministry of Foreign Affairs of Thailand — Consular Department (กรมการกงสุล) — Submit the notarized document to the Thai Ministry of Foreign Affairs (MFA) Consular Department for official authentication. This confirms the document is genuine under Thai law. The MFA is located in Bangkok; processing times vary.
- Authentication by the Colombian Embassy/Consulate in Bangkok — After Thai MFA authentication, the document must be presented to the Embassy of Colombia in Bangkok (Athenee Tower, 63 Wireless Road) for Colombian consular authentication. This step confirms that the Thai MFA authentication is valid and that the document can be officially recognized in Colombia. - Certified Thai-to-Spanish translation and submission to Migración Colombia — All authenticated documents must be translated from Thai into Spanish by a certified/sworn translator recognized in Colombia.
