Traffic Accident in Colombia as a Foreigner 2026: SOAT, FONSAT, and How the Three-Layer System Protects You

SOAT covers victims regardless of fault. FONSAT covers when the driver flees. Art. 11 medical plan covers the excess. How to activate all three — and what to do in the first minutes that determines your coverage.

Sarah — a 29-year-old British teacher cycling to work in Bogotá's Chapinero neighborhood — was knocked down by a motorcycle that ran a red light and drove away. She was taken by ambulance to a private clinic with a broken collarbone and a suspected concussion. At admissions, the first question was about insurance. She had her Art. 11-compliant medical plan. What she didn't know — and what the clinic's administrative team walked her through — was that a parallel system also applied: the SOAT (obligatory vehicle insurance), which covers accident victims regardless of fault, and since the motorcyclist had fled, the FONSAT (National Guarantee Fund), which steps in when the responsible vehicle is unidentified or uninsured. Her final out-of-pocket cost after three days of hospitalization and surgery: zero. The combination of SOAT/FONSAT and her medical plan had covered everything.

Colombia's traffic accident compensation system has three layers that work in combination for foreign victims — the SOAT, the FONSAT, and the Art. 11 medical plan. Understanding how they interact, and what to do in the first minutes after an accident, determines whether the financial protection actually works.

The SOAT: What It Covers for Foreign Victims

The SOAT (Seguro Obligatorio de Accidentes de Tránsito) is Colombia's mandatory vehicle insurance — every vehicle in circulation must carry it. It covers accident victims — not just the insured driver — regardless of fault. For a foreigner injured by a vehicle with a valid SOAT, the process is: go to any IPS (healthcare provider) that handles emergencies, provide the license plate of the vehicle involved, and the SOAT insurer directly assumes the medical costs up to the coverage limit (500 UVT in 2026, approximately COP 26.5 million). SOAT also covers disability payments and death benefits. The coverage applies to Colombian nationals and foreigners equally.

The FONSAT: When the Responsible Vehicle Flees

The FONSAT (Fondo Nacional de Garantías), administered by Colombia's Ministry of Finance, acts as an insurer of last resort when: the responsible vehicle fled the scene, the vehicle has no valid SOAT, or the vehicle is unidentified. The activation process is the same as for SOAT: emergency treatment at an IPS, a police accident report (Informe de Accidente de Tránsito — IAT), and a formal claim filed with FONSAT. Foreign victims access FONSAT on equal terms with Colombian nationals.

The Art. 11 Medical Plan and Traffic Accidents

Medical assistance plans that satisfy Art. 11 of Res. 5477/2022 cover medical, surgical, and hospital expenses without distinguishing whether the cause is illness or accident. Traffic accidents fall under "external-cause events" (eventos de causa externa) — and are covered within the plan's limits. The plan operates in parallel with the SOAT: SOAT covers up to its limit; if the costs exceed it, the medical plan covers the excess. For serious accidents — polytrauma, neurosurgery, ICU — the combined coverage of SOAT/FONSAT and the Art. 11 plan is the complete financial protection for a foreign resident.

What to Do in the First Minutes

The correct immediate actions: call 123 (unified emergencies) or 125 (Traffic Police); photograph the license plate of any vehicle involved before it moves; do not move an injured person if spinal injury is possible; at the clinic, declare that the injury resulted from a traffic accident to activate SOAT coverage from admission; and preserve the police traffic accident report (IAT) as the claim document for both SOAT/FONSAT and the medical plan.
